Bajan back after jailing

Bajan back after jailing FLASHBACK TO 2003. Julia Elliott examining for the first time notice of appeal from Canadian authorities.

By Maria Bradshaw | Fri, September 03, 2010 - 12:00 AM

JULIA Yvonne Elliott, the Barbadian woman who was accused of murdering her Canadian lover more than 15 years ago, is back in Barbados after spending five years in prison in Canada.

WEEKEND NATION investigations reveal that Elliott quietly returned to Barbados on Wednesday.

Reports indicate that she appeared before a Parole Board last month, at the Grand Valley Correction Institute For Women, where she was serving her sentence and a decision was made to release her two years early.

Elliott, who operated a massage parlour here has left behind a historical legal trial in Canada.

Now 48, she first went on trial in 1998 for murdering 64 year-old Larence Foster, in 1995. But the presiding judge Paul Cosgrove freed her after four years on remand and accused the prosecution and police of committing 150 constitutional violations against her.

She returned to Barbados a free woman but the Canadian authorities refused to give up and in 2003 she was arrested on an Interpol warrant while living in Costa Rica and deported to Canada. This time around she threw in the towel and pleaded guilty to manslaughter.

Last year, the judge who freed her, resigned from the bench, thereby avoiding being the first judge in that country to be fired. He was accused by the Canadian Judicial Council of abusing his powers during Elliott’s trial.

Then earlier this year, her attorney Kevin Murphy was suspended from practising law for six months after admitting to verbally abusing witnesses and making unfounded accusations against opposing lawyers during the notorious trial.

Elliott was said to have brutally killed Foster and dismembered his body. The body parts were found floating in a river after a massive search.

This was very poorly written report.  The reporter seems to have gone to great lengths to give the impression that this woman was only accused of the crime but never convicted.

One does not plead guilty because one is innocent but more often because one does not want to risk conviction on the greater charge of murder for which the punishment is far more severe.  The offer is made by the prosecution because they are not sure they have enough evidence to win a conviction for murder.

The report does serve one useful purpose however. It should be a warning to older men in Barbados who may find this woman attractive and want to date her. Caveat emptor.

To Observer: You should examine the facts of this case before passing judgment. Many of us who followed this case diligently are not convinced that the lady was guilty of the crime. Many confessions in North America are “signed” under significant duress (ie: Pain). Paul Cosgrove, a fine and outstanding gentleman and legislator, had the nerve to expose a faulty system and was vilified by the Old Boys Network for so doing.

Wow. This woman has caused death and destruction…. causing people to lose their careers and dignity. Hope her psychological issues were addressed during her incarceration. Another loose cannon bout the streets of Bim now.

If she did murdered this man I do hope that she has ask God for forgiveness. I would think that willfully taking someone life is evil beyond evil and if someone can do such a thing and have a good night rest, then they truly don’t have a conscience.

Court records show she confessed to stabbing him in the neck, gathering up his valuables and belongings in Canada, and getting cash advances on his credit cards to ship his belongings to Barbados. She was dating another Canadian man whilst she did this and he did not know that she did it. When she was caught she tried to implicate the new guy but fortunately he was able to show he was innocent.

What about this report that caught my attention is that the Judge retired and then the attorney was suspended for violations. This would never happened in Barbados because no one pays attention to such matters as wrong doing in the profession.
