Judge: No threat to national security

High Court judge Justice Margaret Reifer has ruled that there were no grounds which threatened national security in the judicial review application sought by suspended Commissioner of Police Darwin Dottin against the Police Service Commission and Governor General Sir Elliott Belgrave.
Justice Reifer’s written 29-page judgement was released yesterday, a day after she announced her decision to deny Dottin’s application to return to work.
The judge said “that the evidence provided by way of affidavit evidence in this matter does not, at this stage of the proceedings meet the threshold necessary to successfully ground a plea of national security.
“Stated differently, there is no cogent evidence of potential damage to national security flowing from the trial of the issues . . . whether in open court or in camera, to justify any modification of the court’s normal procedure.”
