 Security was tightened at the Holetown Magistrates’ Court yesterday when a 42-year-old painter appeared to face murder and kidnapping charges. Dave Powers, of Block 1G, Division Drive, Eden Lodge, St Michael, was not required to plead to the indictable charges. He is accused of killing 32-year-old chef Kari Nolan Cumberbatch last week in a daylight shooting at the car park of the upscale CinCin By the Sea Restaurant, Prospect, St James. Cumberbatch was shot metres away from his workplace, and died slumped over the steering wheel of his car around 10:30 a.m. on January 16. Magistrate Barbara Cooke-Alleyne remanded Powers to Her Majesty’s Prisons Dodds, St Philip, until Tuesday, February 19. Along with murder, Powers was also read charges of removing his estranged spouse Alveina Powers from the restaurant without her consent on January 16, and attempting to unlawwfully kill her on the same date. According to police reports, Cumberbatch, a line chef at CinCin, and Alveina, the restaurant’s lunch manager, were both sitting in the vehicle when he was shot from point blank range.Alveina was treated for a head wound at the Queen Elizabeth Hospital and discharged later that day. An eyewitness, another employee of CinCin, told the MIDWEEK NATION Cumberbatch had dropped his girlfriend to work when they were approached by a man in the car park, and the incident occurred. Powers is also charged with possession of a firearm without a valid licence and possession of four rounds of ammunition without a valid licence.He was represented by attorney at law Senator Verla Depeiza. During the brief appearance, Depeiza informed the court that paperwork served on her client remained unsigned, and would have to be signed to be considered an official document of the court. The magistrate assured her the oversight would be rectified.Police cleared the courtyard just after 9 a.m. when a large crowd gathered to get a glimpse of the accused. People who did not have cases to be heard were ushered outside the gates, and those within the confines of the court were asked to step inside by police. In addition, members of the Barbados Defence Force arrived around 9.30 a.m. The soldiers, wearing camoflauge fatigues, bulletproof vests and carrying M-16 rifles, were stationed at the front and rear of the small court. barryalleyne@nationnews.com
