THE 11 MURDERERS ON DEATH ROW at HMP Dodds will have their mandatory death sentences set aside with the passage and proclamation of the Offences Against the Person (Amendment) Act, currently being debated in Parliament, says former Attorney General Dale Marshall.
But given the wording of the new amendment, the Chief Justice, who is expected to review each of the convictions to determine an appropriate sentence when the new act is proclaimed, will be unable to reimpose a death sentence even if he considers the murder was particularly heinous.
Marshall contends the wording of the act needs to be changed to ensure the Chief Justice has a range of options open to him when that time comes.
