

THE RAMIFICATIONS of having casual sex with an unknown partner, especially if that partner is 12 years-old, are many, a High Court judge warned yesterday.
There is the risk of contracting a sexually-transmitted disease or, said Justice Maureen Crane-Scott, receiving a stay in prison.
"Casual sex," the judge said, "carries with it many risks - health as well as legal and criminal risks.
"It just so happened that stealing a piece with that particular sexual partner landed you in deep trouble with the law since your partner turned out to be a child of 12 years."
In addition, underaged girls must be protected from themselves and from sexual exploitation, she stressed.
The judge was speaking as she dealt with self-confessed statutory rapist Ryan David Caroll, 26, formerly of Market Hill, Jericho, St George, and now of Deacons Farm, St. Michael, who was back in the No. 4 Supreme Court for sentencing.
Earlier in the Sessions, he had pleaded guilty to having unlawful sexual intercourse with a 12-year-old girl between December 26 and 28, 2007.
Justice Crane-Scott jailed him for two years and ordered that he receive drug awareness counselling while in prison.
The judge noted she had no intention of going over the facts "as ridiculous as they were".
"I think the many people who were here heard the circumstances in which the girl and you basically spent two nights on a fridge in the bush," the judge told Caroll.
She further told him the maximum penalty for his crime was life in prison, and that punishment was there because Parliament and Barbadians viewed such offences as very serious.
"Barbadian society therefore considers and, in this court's opinion, rightly so, that a child, and in particular a girl who is under the age of 14, is to be protected from sexual exploitation by anyone who would take advantage of her and prey on her weaknesses and vulnerability," the judge said.
"Barbadian society believes, and rightly so, that children must remain children. They must be protected from themselves and others who would sexually exploit them," she said.
The judge further told the rapist she considered his offence so serious that only a custodial sentence would suffice. Her starting point, she said, was five years, but she had considered his guilty plea, his pre-sentencing report and attorney Kenneth Best's plea of mitigation.
"The court is of the view that the ends of justice are better served by the imposition of a relatively short custodial sentence designed to make you realise the seriousness of your actions and the serious consequences which must inevitably flow," Justice Crane-Scott said.
"The court is convinced that by now you must realise how stupid and irresponsible you were to have had sexual intercourse with someone you had only just met a few hours before and about whom you knew absolutely nothing."
The matter was prosecuted by Principal Crown Counsel Wanda Blair and Senior Crown Counsel Roy Hurley.
The court had heard that the girl left to go to her father's house on December 26, 2007, but up to when her mother returned home around 11 p.m., she girl had not come back.
The next morning, December 27, the woman checked the girl's bedroom and realised she was not there. The woman called the girl's father, who said she never got there.
On December 28, the woman got a call from police and she went to District "C" Police Station where she collected her daughter.
The pre-teen girl told police she saw Caroll when she got off a bus on Crumpton Street, The City. They walked around Bridgetown for hours as she tried to catch a bus to her father's house before she decided, around 9 p.m. that she was going to Caroll's house, but when they got there, Caroll's girlfriend started to quarrel.
Eventually, Caroll and the girl ended up in a bushy area where they had sex and fell asleep on an old fridge.
The girl spent all of December 27 with Caroll but spoke to police on December 28.
On December 29, 2007, Caroll was interviewed by police and he told them: "Yes, I had sex with her, but I did not know she was 12 years old."

This young man should not have been the only one to feel the weight of the judicial system. Be as it may, I would agree that he was the one on trial for his stupidity, but he was not the only one who committed an offense in this case. Not to punish the parents and the child in some form is sending the wrong message to other parents and to our youths. The parents should have been punished even it were a monetary fine for being so lax under the circumstances. As for the child who deems herself wanting to do as she pleases and express herself as an adult, she should be punished even if it meant her parents taking her to visit the young ladies living in juvenile detention (Dodds) either after school or weekends so that she can get a taste of what it is like when one does not obey. But then again the pigeon may have been out the cage for too long and it’s not easy to get it back where it belongs.

The man was wrong as hell but also an idiot. I will never excuse his actions and he deserves what Jippy Doyle got. We, however, have to also look at the activities of our girl children and our boy children. Yes they are underage, but many are precocious and are victims only in the sense of their ages and the law. They lie about their ages, seek out big hard back men (who are weak and criminally inclined) and offer services to them sometimes for money. Yes, the parents perhaps can share one third of the blame here, but I know instances where parents try their best and the kids just turn out rude and deviant. Please recall the case some time last year where there was an actor visiting Barbados overseas and the parents allowed the child to go with the man the 'come back to the room later'; the man and the girl had sex since 'she wanted it' and then suddenly it was rape. Luckily for him, I think the girl was slightly over the age of consent, otherwise he would have been in big trouble. My closing remarks...because of the law, we are obligated to look at the perpetrator, but morally, we gotta look at the girl and the parents also. (P.S. What a sad state of affair, and a perfect discription of child abuse. Most of the comments touched on the child's behavior which is not the issue in this case. This is about, parental abuse, child neglect, and abuse, and the raping of a child in great depth. Child abuse is a complex set of parental behaviors, and the child;s response to these behaviors. It is a multifaceted personal, familial, community, and societal phenomenon. I wish l had the time to elaborate on this but, as a Practitioner, and seeing that we have physical, sexual, neglect, or emotional/psychological, and victimization where the rapist took advantage of an inocent child, and seeing the sentencing of this rapist, l have to question, what is Barbados' definition of child abuse? I hope l will get the opportunity to elaborarete on this subject later on.

Some people need to truly wake up and smell the coffee. The parents, the girl and the young man are All in this together. Let the chips fall where they may. IMHO, this 12yr old has been categorized as a child because of age ONLY and nothing else. If people continue to give sympathy with the "cud-dear" she is only 12 years, this young lady and maybe others in her age group will continue to do the same and probably go beyond, knowing that they will have adults and the law on their side. Chupse. Let’s face it; if it had been proven that she was raped and not scraped which seem to have taken place in this situation, there would have been more serious charges brought against the young man. The judicial system probably got the drift and saw directly right through her and the parents, and that she is no virgin—she is accustom to spreading her legs, and not only to take a bath.

Let me start by saying, I am in no way condoning the actions of this man; he deserves some form of punishment to send the message to others that such offenses will not be tolerated – that men AS WELL AS women need to think with their brain and not with what is in their pants and panties Now, having said that, this child is getting lots of sympathy because of her age; however, I doubt this is her first encounter with a penis whether from a mature person, a teenager or someone around her age group. Any father of a minor should be visiting a child at the mother's home or vice versa. You do not let a child catch a bus alone after a certain time. Then it was a bank holiday, the buses don't run as frequently as on other days. They should have locked up the mother at the same time too. Even if we excuse her for making the mistake of allowing the child out unsupervised, she should have picked up the telephone and called someone to find out if the child arrived at her intended destination safely. We live in a society where even a four year old has a cell phone. She allowed the perverts the opportunity to prey on her child. Some mothers have relinquished their responsibilty of communicating with the other parent to the children. They tell the child to call the father or send the child to collect money for child support. Even if the child was already wayward (and this is no excuse for the man to molest her), the parents were wrong in this case. To tell the truth I am more upset with them than the big bad dog who was lurking to gobble up their child. They should feel guilty for this as well as the fact that this child had to go through this psychological hell with this case in the presence of others. "Foolishness is bound up in the heart of a child" so I forgive her, she is still a child. I hope she is receiving some type of counselling for low self esteem and the fact that Barbados is a small place and everyone knows your business better than you do. She still has to go to school. I hope the rapist asks God for forgiveness because their is no room in heaven for this "species" of mankind (dogs). I can not find a fitting earthly punishment for him, but I could find a charge for the parents, lock them both up and place the child in a more responsible setting. This child is now in proverbial tatters and will be incorrectly labelled as delinquent by many who will be quick to judge her. Then we need a good foster program in a regular loving home for these children of parents who don't care about them. I commend all of those whose eyes are open to the fact that not all children are innocent, and I am also glad that some of u have realised that ALL are to blame in this case. The situation should not by no means end with Carol being imprisoned, which by the way I am highly glad about. The child needs to be protected from herself and sometimes to do that requires punishment [and yes more than that - I KNOW], so let's not be in denial about that. I hope the parents have no other kids, for as Angry Father said, they are no fit to raise pigs. I just wish people would wake up to the promiscuous acts of kids - even from those with loving families and environments. I do not applaud Carol; I think he is quite STUPID. I don't want people to get the impression that my earlier post was a call to import US-style "justice" to Barbados. I live in the US and understand that there is very little that is just about the legal system in the US. Having said that, we have to acknowledge that children do very stupid things sometimes and don't recognize the danger they put themselves in. We as adults are the ones who are supposed to exercise better judgment. The unfortunate thing about this case is that none of the adults involved exercised good judgment. It does not matter how badly this man felt this little girl "wanted it", he was the adult and should have had the wisdom and self-control to send her on her way. His mother who scolded him for bringing the "child" home should have taken control and contacted the girl’s parents or the authorities. The girl’s mother, who did not bother to inquire about her daughter's whereabouts until the next day, is not fit to raise pigs let alone children. The child should be removed from her custody. I agree that there should be far stiffer punishments for statutory rape, but there should be a provision made for young (albeit foolish) lovers who are within four years of each other. We don't want 17 and 18 year old boys going to jail for being with their 15 and 16 year old girlfriends. We just want the much older men & women who prey on these naive youngsters to see stiffer jail sentences. Barbados needs to prioritize what crimes need the most attention. When a shiftless pot smoker can get more jail time that a child molester, something is seriously wrong!!

There is more than enough blame to go around. Sadly, some of these youths are too advanced for their age, to put it mildly -- young upstarts especially when they look older than their age, furthermore dress like adults to disguise their age. In my opinion the defendant received an adequate punishment for first offense that we know of, given the girl's prior mischievous behavior, and taking into consideration he owned up from the very beginning to a serious crime, which most likely he anticipated could have landed him in prison for more years than he has fingers and/or toes. I was following this case with mild amusement at times, but mostly with disgust. This big hard back man brought home this child to his mother's home and was admonished by his mother and sister for bringing home 'child to sleep with'. If they could see that the girl was not even mature enough to pass for 16, why couldn't he. His excuse that he didn't know she was 12 is laughable. He should have been given a heavier sentence because he is not the only man in Barbados that does this. There are men out there who only sleep with girls under 16. I don't know if it is size or lack of understanding REAL women, but they prefer little girls. Barbados need to pass a law that would have these phedophiles registered as sex offender once out of jail, and be on probation for an extended period of time. Restrictions would include not having any contact with children, staying away from areas that have schools,parks, etc. When these adults cannot have any contact with they own juvenile children or family members then they would know how they behavoir have impacted not only themselves,but the people close to them. As well as the victims and their families. The laws of Barbados are too lacks, and the predetors know this. I have experienced statutory rape this in my family. With the police saying they cannot do anything because it is in the hands of the childcare board. When the childcare board is contacted all you hear is excuse after excuse after 2 years. As a family member I can tell you it took great restrain to convince the person responsible for the care of this child not to take the law into their own hands. Check ur records and see how many paedophiles in your area have raped multiple children using violence and are still out on the streets after a short imprisonment or probation.....there is website that let informs you how many registered sex offenders are in your area.....use it & then tell me if you still think B'dos' justice is better or worse.....fact remains although the sentence could've been longer, 2 years is not out of place given the facts of the offence which did not include violence, and it appears that the accused man had no prior criminal history.

Let's not place the blame squarely on his shoulders. Hopefully he would have learnt his lesson and will find out his conquests age before lying next to them. Maybe he should ask for ID next time lol

There is absolutely no excuse for this man's behavior. Even if he expected that the girl was leading him on, which I do not believe, he is of age and should have send her home. She is a child. Two years in my estimation is a slap on the cheek. Hard labor should have been added to his sentence.

Unfortunately, it was only the guy who was put on trial for his stupidity, and not the parents for being negligent, and the child for her wayward behavior. it sounds like the girl might have been experienced and "fast" for 12. but this does not excuse teh behaviour of a grown man to be bothering with her. send him to Dodd's...let him play with the boys in there.

Two years is a start, but ridiculous. I just hope they don't let him out early for good behaviour. That "child" should be in prison, sitting in a cell next to his, with the parents across the hall. I will never understand how my daughter left my place to go by her father and then to return, and after 11 and I don't see her and I not call her father until the next day to find out if she is there etc. Especially with this child's reputation of constantly running away. That was really bad judgement on the mother's part and says a lot about her parenting. The father too should be chastised if he knew his daughter was to be coming to his residence and not call to inquire as to her lack of arriving. Everyone in the situation is guilty. Carol got his punishment now. If this family doesn't wake up, they will get their punishment later

I commend this judege for what she did. Two years ago we found out that a 30 something year old was having sex with a 12 year old. It even began earlier than than, we reached out to the authorites and the child board, who told us that they couild not do anything because the mom refused to press charges, even though the man and daughter admitted to her about it. We as family members tried to intervene, but our plea fell on death ear. Why did this go unheard? I think that this guy should still be ounished for the crime along with the mom
