LAWYERS REPRESENTING Commissioner of Police Darwin Dottin are expected to submit today before Justice Margaret Reifer that Governor-General Sir Elliott Belgrave acted outside of the law when he reportedly advised the Police Service Commission (PSC) that the top cop be placed on administrative leave three weeks ago.
In the application for an interim injunction, they will also argue that any such decision or advice was in breach of the principles of natural justice and that it was also “an improper and or irregular and or unreasonable exercise of discretion”.
The matter is scheduled to have its first hearing today before Justice Reifer in chambers.
In the June 17 letter sent by the PSC and signed by its chairman, attorney at law Guyson Mayers, Dottin was told that he was being retired from the office of Commissioner in the public interest.
But Dottin’s lawyers led by Elliott Mottley, QC, and Leslie Haynes, QC, have charged that the letter is invalid and ineffectual. (TS)
